So, since you are an attorney, I hope you don't mind if I ask you a question. [img]/forums/images/graemlins/smile.gif[/img] Do you know about real estate laws? I am trying to sell my house w/o an agent, and was told I should use an attorney. For what, I don't know. The title company did the paperwork when we bought it and I don't recall any attornies being involved. Any ideas or thoughts about why or if I need one? Thanks!

I'm not a real estate attorney, so I'm afraid I can't really tell you specifically what benefit a real estate attorney would bring. My guess is you would want some assistance with the contract to sell your house, and the other disclosures that sellers must by law comply with.

In Colorado, a company by the name of Bradford Publishing sells "kits" with all the paperwork you need to sell a house. In fact, I used the kit myself when I sold my house several years ago, and handled the transaction just fine without a realtor. (Though we had a buyer already lined up. I never would have had the patience to sell it myself if we hadn't.) Maybe you could check to see if there is something similar in Utah. (Check on-line, or maybe in your local library or bookstore.)

As to the attorney vs. lawyer thing, there isn't any difference (as opposed to the system in, say, England where there are barristers and solicitors with very different roles). I guess I always say attorney because I'm a City Attorney and a Town Attorney (represent cities and towns). Oh, and people usually tell "lawyer jokes" instead of "attorney jokes." (Just kidding about that last thing [img]/forums/images/graemlins/laugh.gif[/img] ).

Thanks for the info! It looks like there is a "house selling for dummies"!! And a few other things I can check, and hopefully not need an agent. We have had a sign up for 4 days, 15 fliers taken, one couple walked through after they saw it on the website, and love it and are hoping to make an offer, so I hope we can handle this! I hate giving an agent $9K just for looking at a few papers!
