Well how about this for timing. Nick just received a notice at his parents' house that Mesa tried to deliver a certified letter. No doubt itis the training money they want. I was hoping... praying that it would fall through the cracks somehow. Nick clarified that he did get his vacation paid out but they held his last paycheck. He doesn't have access to the Mesa employee system anymore and doesn't think he can prove they held his last check. Is it legal to hold a check?

We are both sick over this. Money is constantly going out, but not as much is coming in. What a tough year this is.
The training contract will cost us several thousand dollars to pay back.

Wow Amanda! I can't believe Mesa does that! That is really crappy.

Well there are a couple of competing issues. Their CBA could permit holding the last check. That supercedes wage and hour laws. If it is silent, then there are two others. Arizona law allows employers to hold a check if there is a "reasonable" dispute--whatever that is. But the federal Fair Labor Standards Act prohibits an employer from paying less than minimum wage. Taking his entire check reduces his hourly rate to $0 which is below the minimum wage.

But you have to start with the CBA.

It seems like indentured servitude. You're always training for something, so the cycle starts again for another year!

how long was the contract for? i would have thought if he'd stayed over a year, he was no longer obligated.. and he was there for 3 years?!

Mesa's contract is for one year--but they get you for each training. So, new hire training= 1 year; transition to another plane = 1 year; upgrade= 1 year, etc. It's indentured servitude. That's why they are a bottom feeder!

On that training contract/payback issue, does anyone know if the major airlines tend to do that- specifically United? I may be putting the cart before the horse, but that seems to be a recurrent theme in this relationship.

Not that I know of--but if it means anything there's a slot open at United because DH's cousin is not going back. He said it was so bad pre 9/11 and even worse post 9/11. He'd rather be a special ed teacher, come home at 2 PM, work the same schedule as his wife who is a speech pathologist and have a second pension (on top of his military pension from being in the AF 22 years and retiring as a Col.). Plus Tilton has said they are up for sale--so who knows?

I asked DH about it (b/c I was wondering if any of these former Mesa guys have said anything about all this) and he said (well, the former Mesa guys he has talked to lately have said) that the contract is for 2 years. Yuck. It really sucks they have a contract and make you pay for training if you break it.

but I'm not sure if any of them had upgraded or transitioned....I don't think they did, but I never asked him that.

I know that Air Wisconsin is employing several former Mesa and SkyWest pilots.

Very interesting about the training contract. I had heard that Mesa had a training contract, but I didn't realize that it was for each new training. YIKES!! Is that spelled out and signed before each new training begins?
